Filing a DMCA Takedown Notice

If you believe that content available through the PulseMesh service infringes your copyright, you may submit a notification under the Digital Millennium Copyright Act (DMCA) by providing our Designated Agent with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;

  2. Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., Display name, track ID, URL, or hash);

  3. Your contact information, including your name, address, telephone number, and email address;

  4. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;

  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

  6. Your physical or electronic signature.

Counter-Notification Procedure

If you believe that material you posted was wrongfully removed, you may submit a counter-notification to our Designated Agent with the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled;

  2. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification;

  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Franklin County, Ohio if you are outside of the United States), and that you will accept service of process from the person who provided the original notification;

  4. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the material in 10-14 business days unless the original claimant files a court action and notifies us.

Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, PulseMesh has adopted a policy of terminating, in appropriate circumstances, accounts of users who are deemed to be repeat infringers. PulseMesh may also, at its sole discretion, limit access to the service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

As a baseline, accounts (including linked Displays and Show Controllers under common control) that receive three (3) valid copyright strikes within any rolling 12-month period are subject to suspension or termination.

Standard Technical Measures

PulseMesh accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works that:

  1. Have been developed pursuant to a broad consensus of copyright owners and service providers in an open, fair, voluntary, multi-industry standards process;
  2. Are available to any person on reasonable and nondiscriminatory terms; and
  3. Do not impose substantial costs on service providers or substantial burdens on their systems or networks.
